The Australian and United Kingdom Governments have agreed to a free trade agreement titled The Australia United Kingdom Free Trade Agreement (A-UKFTA). This agreement will enter into force Wednesday 31st May 2023. Details of in-transit provisions are still to be clarified but we expect that goods on the water at the date of commencement will be eligible for the agreement, subject to presentation of the required documentation. A certificate of origin issued by an authorised body is not a requirement under this agreement. The negotiating parties have agreed to a declaration of origin instead. The declaration of origin (DOO) can be issued by the exporter or producer of the goods (or their authorised representative). In order to access the benefits of the agreement Transways will require a DOO at the time of import clearance. If you are unable to obtain a DOO at the time of import then there is a provision for duty refunds once the DOO is issued. A copy of a sample DOO is available in attachment I Most goods will revert to duty free on the commencement of the agreement with the exception of Cheese, alcohol, tobacco, fuel and many steel products. The steel products will drop to 4% duty immediately and then phase to zero over a 5 year period. The UK Government has however included a clause in the agreement that defines these steel products as safeguard goods. If the UK Government determines that the reduction in duty on these steel items is causing material harm to the UK then they can impose a tariff under the agreement. If the UK imposes such a tariff then the Australian Government will also suspend these goods from preferential treatment when imported into Australia. To be eligible for the free trade agreement the imported goods must be transported from the UK to Australia without entering free circulation in a non-party country. Goods that have entered free circulation in another country will attract duty. Should you require any additional information please contact your Transways Representative.
